Article 1 - Purpose and Scope
These Terms and Conditions of Sale (hereinafter "Terms") govern the contractual relationship between SAS Gîtes du Bassin, hereinafter referred to as "the Lessor", and any natural or legal person, hereinafter referred to as "the Tenant", wishing to make a reservation for a seasonal rental of a furnished tourist accommodation.
The cottages are located at 7 avenue Charles Gounod, 33510 Andernos-les-Bains, France.
Any reservation implies the Tenant's unreserved acceptance of these Terms, which take precedence over any other document.
Article 2 - Description of Services
The main characteristics of the cottages (surface area, number of beds, equipment, services included) are presented on the website www.gitesdubassin.com and in the descriptions provided when booking.
The Lessor undertakes to provide services in accordance with the description presented. Photographs and descriptions are provided for information purposes only.
The cottages are classified as furnished tourist accommodations and meet current standards.
Article 3 - Booking
3.1 Booking Methods
Reservations can be made:

3.2 Booking Confirmation
The booking becomes firm and final after:
- Signature or acceptance of the rental agreement
- Payment of the deposit within the specified time frame
- Receipt of written confirmation from the Lessor by email
3.3 Minimum Rental Period
The minimum rental period may vary depending on the season. It will be specified when booking. In accordance with regulations, the rental period cannot exceed 90 consecutive days for the same tenant.
Article 4 - Prices and Payment Terms
4.1 Prices
Prices are indicated in euros, including all taxes. They include the rental of the cottage for the reserved period, as well as the equipment and services mentioned in the description.
The tourist tax, collected on behalf of the municipality, is additional and will be invoiced separately according to the rates in force.
Prices may be revised at any time. However, the applicable price is that in force on the date of booking.
4.2 Payment Terms
Payment is made according to the following schedule:
- At booking: A deposit of 20% of the total rental amount
- No later than 30 days before arrival: The balance of the total rental amount
4.3 Bookings Less Than 30 Days in Advance
For any booking made less than 30 days before the arrival date, full payment is required at the time of booking.
4.4 Accepted Payment Methods
- Credit card
- Bank transfer
4.5 Security Deposit
A security deposit of 1 000 euros may be requested upon arrival. It will be refunded within a maximum of 2 days after departure, minus any damage found or unpaid consumption.
The security deposit can be made by uncashed check, or bank transfer.
Article 5 - Arrival and Departure
5.1 Schedule
Unless otherwise agreed in advance:
- Arrival: Between 4:00 pm and 9:00 pm
- Departure: Before 10:00 am
The Tenant must inform the Lessor of their expected arrival time at least 24 hours in advance.
5.2 Key Handover
The keys will be handed over to the Tenant upon arrival after verification of identity. An entry inventory will be carried out jointly.
5.3 No-Show
If the Tenant does not show up within 24 hours following the scheduled arrival time without having notified the Lessor, the booking will be considered cancelled. The amounts paid will remain acquired by the Lessor, who may also claim payment of the balance.
Article 6 - Conditions of Use of the Cottage
6.1 Number of Persons
The number of persons occupying the cottage may in no case exceed the maximum capacity indicated in the description, unless prior written agreement from the Lessor.
6.2 Use of Premises
The Tenant agrees to:
- Occupy the premises as a responsible person
- Maintain the cottage in a correct state of cleanliness
- Respect the neighborhood and not cause noise disturbances, especially between 10:00 PM and 8:00 AM
- Comply with the house rules provided upon arrival
- Not sublet the cottage
- Not organize parties or receptions without prior agreement from the Lessor
6.3 Pets
The presence of pets is prohibited in our holliday cottages.
6.4 Non-Smoking
It is strictly forbidden to smoke inside the cottage, in accordance with current regulations.
6.5 Electric vehicles
For charging your electric vehicles, our holiday cottages are not currently equipped with charging stations or reinforced sockets. Furthermore, charging your vehicle using standard sockets is strictly prohibited in our holiday cottages.
Article 7 - Liability
7.1 Tenant's Liability
The Tenant is responsible for all damage caused to the cottage, equipment, and furniture during the rental period. They must reimburse or have repaired at their own expense all damage found.
The Tenant must be covered by civil liability insurance "vacation rental" covering damage that may be caused to the cottage and its contents. A certificate may be requested.
7.2 Lessor's Liability
The Lessor is covered by professional civil liability insurance.
The Lessor cannot be held responsible for:
- Theft or loss of the Tenant's personal belongings
- Damage caused by force majeure events
- Failures or interruptions of public services (water, electricity, internet) beyond their control
- Modifications to services or equipment necessary for safety or urgent maintenance reasons
Article 8 - Cancellation
8.1 Cancellation by the Tenant
Any cancellation must be notified in writing (email or registered letter with acknowledgment of receipt) to contact@gitesdubassin.com.
In case of cancellation:
- More than 60 days before arrival: Full refund of the deposit. Cancellation is free of charge.
- Between 60 and 30 days before arrival: Refund of the deposit minus €50 for administrative fees
- Less than 30 days before arrival: Retention of 100% of the deposit
8.2 Interruption of Stay
In case of early departure by the Tenant, for any reason, no refund will be made.
8.3 Cancellation Insurance
The Lessor strongly recommends that the Tenant take out cancellation insurance covering the risks of illness, accident, or other unforeseeable events.
8.4 Cancellation by the Lessor
The Lessor reserves the right to cancel the booking in case of force majeure or exceptional circumstances making it impossible to make the cottage available.
In this case, the Tenant will be fully refunded the amounts paid, without being able to claim additional damages.
Article 9 - Booking Modifications
Any request for modification (dates, number of persons) must be made in writing and remains subject to the Lessor's acceptance and the cottage's availability.
If a modification is accepted, administrative fees of 30 euros may be applied.
Article 10 - Complaints
Any complaint regarding the rental must be made in writing within 8 days following departure, by email to contact@gitesdubassin.com or by registered letter with acknowledgment of receipt.
The Lessor undertakes to respond within 15 days.
Article 11 - Personal Data
In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Tenant has the right to access, rectify, object to, and delete data concerning them.
The data collected is necessary for processing the booking and will not be transmitted to third parties without the Tenant's consent.

Article 12 - Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to accommodation services, other than residential accommodation, goods transport services, car rentals, catering, or leisure activities that must be provided on a specific date or period.
Therefore, no withdrawal will be possible once the booking is confirmed.
Article 13 - DISPUTE – CONSUMER MEDIATION
In the event of a dispute between the Customer and the business, the parties will endeavor to resolve it amicably (the Customer will submit a written complaint to the business or, if applicable, to the business’s Customer Service Department).
If no amicable agreement is reached or if the business fails to respond within a reasonable period of one (1) month, the consumer-customer, as defined in Article L.612-2 of the Consumer Code, may, if a dispute remains unresolved, refer the matter free of charge to the competent mediator listed on the roster of mediators established by the Commission for the Evaluation and Oversight of Consumer Mediation pursuant to Article L.615-1 of the Consumer Code, namely:

Article 14 - Applicable Law and Jurisdiction
These Terms are governed by French law.
In case of dispute and in the absence of an amicable settlement, the competent court will be that of the jurisdiction of the Lessor's registered office, namely the Bordeaux Judicial Court, unless otherwise provided by public policy provisions.
Article 15 - Miscellaneous Provisions
If any clause of these Terms is declared null or unenforceable, the other clauses shall remain in force.
The Lessor reserves the right to modify these Terms at any time. The applicable Terms are those in force on the date of booking.
